Terms of Service

1. Acceptance of Terms

By accessing or using EduGarden ("the Service"), available at edugarden.in, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, please do not use the Service.

2. Description of Service

EduGarden is an AI-powered study companion designed for Class 12 CBSE students. The Service provides:

• AI tutoring via chat, including solving photos of questions you upload
• Study tools: formula reference, chapter tests, full board papers, revision notes, derivation walkthroughs
• Gamification: XP, badges, streaks, virtual garden
• Study planning, progress tracking and a predicted board score
• A progress report you can choose to share with a parent or guardian
• An invite programme that rewards you for referring friends

3. Eligibility and Users Under 18

The Service is intended for Class 12 students. Signing in requires a Google account, and Google sets its own minimum age for account holders, so we do not separately verify a lower age limit.

If you are under 18, Indian law treats you as a child. You may use the Service only with the consent of a parent or legal guardian, which we collect and verify during onboarding. By using the Service you represent that you meet these requirements and that any information you give us about your age is true. Section 7 of our Privacy Policy explains exactly what changes for users under 18.

4. Accounts and Guest Mode

• You may sign in using Google OAuth. You are responsible for the security of your Google account.
• You may use EduGarden as a guest without signing in, with limited features and a lower daily limit.
• You are responsible for all activity under your account. One account per person.
• You may delete your account at any time from your profile page.
• We may suspend or terminate accounts that violate these terms.

5. Plans and Payment

EduGarden is free to use. We also offer the following paid plans:

• Payments are processed securely by Razorpay. We never see your card or UPI credentials.
• No plan renews automatically. Access ends on the expiry date and you buy a new plan if you want to continue.
• The Board Season Pass is offered only when your board exams are close enough, and its access ends on your board date rather than after a fixed number of days.
• You may share a payment link so a parent or guardian can pay on your behalf. The subscription attaches to your account.
• Coupon codes, where offered, apply a discount at checkout. We may withdraw or expire a coupon at any time.
• Prices are in Indian Rupees and include applicable taxes unless stated otherwise. We may change prices; a change never affects a plan you have already paid for.

6. Fair Use and Daily Limits

Every plan, including the paid ones, has a daily limit. AI usage costs us real money, so no plan is unlimited. At present:

Other AI features (revision notes, mock tests, derivations) draw on the same daily message allowance at different rates. Limits reset daily at midnight IST. New accounts get a temporarily higher allowance in their first two weeks. We may adjust these limits; if we reduce them materially for a plan you have already paid for, you may request a pro-rata refund.

7. Referrals

• You get a personal invite link. When a friend signs up through it and genuinely uses the Service, both of you earn free premium access days.
• Rewards are granted only for real, distinct people. Self-referrals, duplicate or automated accounts, and bought traffic are not allowed.
• We may withhold, revoke or reverse rewards obtained in breach of this section, and suspend the accounts involved.
• Referral rewards have no cash value and are not refundable or transferable.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to our systems or other users' data
• Use the AI tutor to generate harmful, abusive, or inappropriate content
• Upload photos containing other people's personal information, or content you have no right to share
• Scrape, copy, or redistribute content from the Service
• Circumvent daily limits, the paywall, or the referral rules
• Interfere with the Service's operation or other users' experience
• Misrepresent your identity, your age, or impersonate others
• Use automated tools to access the Service beyond normal usage

9. AI-Generated Content Disclaimer

EduGarden uses artificial intelligence to generate educational content including explanations, solutions, tests, predicted scores and study plans. While we strive for accuracy:

• AI-generated content may contain errors or inaccuracies
• The Service is a supplementary study aid, not a replacement for textbooks, teachers, or coaching
• Predicted board scores are an estimate from your activity in the app, not a forecast of your real result
• We do not guarantee specific academic results, exam scores, or outcomes
• Always verify important information against your textbooks and teachers

10. Intellectual Property

• The EduGarden brand, design, code, and original content are our intellectual property.
• You retain ownership of your chat messages, uploaded photos and study data.
• By using the Service, you grant us a limited licence to process that content solely to provide the Service to you.

11. Limitation of Liability

To the maximum extent permitted by Indian law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the preceding 12 months
• We are not responsible for service interruptions, data loss caused by clearing your browser storage, or third-party service outages

Nothing here limits liability that cannot be limited under Indian law.

12. Termination

We may suspend or terminate your access at any time for violation of these terms. You may stop using the Service, or delete your account, at any time. If we terminate a paid account for a reason other than your breach, we will refund the unused portion of your current plan.

13. Governing Law

These terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at Amritsar, India.

14. Changes to Terms

We may modify these terms at any time. We will notify users of significant changes in the app. Continued use of the Service after a change constitutes acceptance.
